Controversial audios were revealed of peruvian judge, César Hinostroza, is heard negotiating various issues, one of them being the released of a man sentenced to 30 years in prison for raping a 13-year-old girl. According to a tv program, César Hinostroza, along with four other judges, released Mauricio Faustino Huamani, sentenced for the crime against sexual freedom in the form of sexual violation of a minor and sexual proposals to an adolescent.
The girl was sexually assault in 2013. Mauricio Faustino Huamani contacted her through Facebook. After meeting in person, he took her on several occasions to hostels, where he sexually assaulted her. The man was sentenced to 30 years in prison, however his defense filed an appeal for nullity before the Supreme Court, where the head was Judge César Hinostroza.
In an statement of Lima’s Second Transitory Criminal Chamber of the Supreme Court, on February 2017, Judges César Hinostroza Pariachi, Ventura Cueva, Pacheco Huancas, Cevallos Vega and Chávez Mella, ordered the immediate release, as long as he does not have another sentence or arrest warrant issued. To make matters worse, they also ordered the nullity of police and judicial records generated as a result of the trial. He was freed.
It should be noted that on July 7th, reporters of the Institute of Legal Defense broadcasted audios where the same judge is heard talking about a rape case of a minor between 10 and 11 years old. There, he also talks about a possible reduction of sentence or even an acquittal.
In Peru, each day 11 cases of violence against women are reported. Lima has the higher rate. 85% of feminicides are committed by the partner or ex-partner of the victim, according to statistics of the Emergency Center for Women. 76% of victims of rape in Peru are minors. 60% were between the ages of 13 and 17 years old. It is hard to be a woman in Peru and It is harder when judges are being bought and sentences are being nulled by corrupted men in power that will bring no justice to any peruvian woman. Hopefully these new audios and new information will clean the justice system of people interested in money and power rather than protection young girls from being raped.
Now the judge has filed a complaint in which he details being a victim of attacks and having received “death threats” to his cell phone and the landline of his current address, as well as through social media. He went to the San Borja district police station and said that the threats revolve around “going to his house and causing material damage.” Likewise, he assures to fear for the integrity of his family. Isn’t it more dangerous to the integrity of other people’s families and children to leaving rapists free ? We will have to wait and see how the investigation ends and how many other criminals have bought their freedom thru negotiating sentences
